By accessing or using the Generate Zero platform, you agree to comply with and be bound by the following terms and conditions. Please read them carefully, as they govern your use of the platform and services provided by Generate Zero.

2. Services Provided

Generate Zero offers tools and solutions for emissions measurement, reporting, and reduction. These services are subject to ongoing development and may change at any time to improve user experience or functionality. We do not guarantee uninterrupted or error-free use of the platform.

3. User Responsibilities

Users must:

  • Provide accurate and up-to-date information for account registration and service use.
  • Not misuse the platform for unlawful purposes, including the manipulation of data or unauthorized access.
  • Maintain the confidentiality of login details and immediately notify Generate Zero of any security breaches.

4. Data Ownership & Privacy

Generate Zero respects user privacy. By using the platform, you agree to our Privacy Policy regarding how your data is collected, stored, and processed. You retain ownership of any data you input into the system. However, you grant Generate Zero the right to use anonymized data for platform improvements, analytics, and research purposes.

Generate Zero Limited (NZCN 8717086) (we, us or our), understands that protecting your personal information is important. This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us, or collected by us, when interacting with you.

The information we collect

Personal information: is information or an opinion, whether true or not and whether recorded in a material form or not, about an individual who is identified or reasonably identifiable.

The types of personal information we may collect about you include:

  • Identity Data including your name, job title, company/organisation name, business registration details, industry sector, profession, pronouns, and gender.
  • Organisation Data including your company or organisation name, business registration number, industry sector, number of employees, and organisational structure information relevant to emissions reporting.‍
  • Professional data including where you are a worker of ours or applying for a role with us, your professional history such as your previous positions and professional experience.
  • ‍Marketing and Communications Data including your preferences in receiving marketing from us and our third parties and your communication preferences.
  • ‍Interaction Data including information you provide to us when you participate in any interactive features, including surveys, contests, promotions, activities or events.   ‍
  • Profile Data including your username and password for the Generate Zero platform, profile picture, orders or subscriptions you have with us, emissions data and reports you create, content you post, send, receive and share through our platform, and support requests you have made. ‍
  • Technical and Usage Data when you access any of our websites or platforms, details about your internet protocol (IP) address, login data, browser session and geo-location data, statistics on page views and sessions, device and network information, acquisition sources, search queries and/or browsing behaviour, access and use of our website (including through the use of Internet cookies or analytics), and communications with our website. ‍
  • Transaction Data including details about payments to you from us and from you to us and other details of products and services you have purchased from us or we have purchased from you. ‍
  • Financial Data including bank account and payment card details (through our third party payment processor, who stores such information and we do not have access to that information). ‍
  • Contact Data including your telephone number, business address and email.

How we collect personal information

We collect personal information in a variety of ways, including:

  • when you interact directly with us, including face-to-face, over the phone, over email, or online;
  • when you complete a form, such as registering for any events or newsletters, or responding to surveys;
  • when you apply for a job with us;
  • when you create an account or use the Generate Zero platform to measure, manage or report emissions data;
  • from your organisation or employer when they provide us with your details as an authorised user of our platform;
  • from our parent company and related entities within our corporate group, including Data Insight and Valocity;
  • from third parties, such as details of your use of any website we operate (from our analytics and cookie providers and marketing providers. Where we collect personal information about you from a third party source other than you (other than the personal information which we have specified will be collected by us in accordance with this Privacy Policy) we will take reasonable steps to notify you of such collection, including the fact that the information has been collected, the purpose for which the information has been collected, the intended recipients of the information, and the name and address of the agency that is holding the information, as required by law. See the “Cookies” section below for more detail on the use of cookies);
  • from single sign-on providers such as Microsoft, Google or Apple when you use these services to access our platform; or
  • from publicly available sources, such as the New Zealand Companies Office, Australian Securities and Investments Commission (ASIC), and professional networking platforms such as LinkedIn.

Why we collect, hold, use and disclose personal information

Personal information: We collect, hold, use and disclose your personal information for the following purposes:

  • to enable you to access and use our platform, including to provide you with a login;
  • to measure, analyse and report on carbon emissions and sustainability data for you and your organisation;
  • to provide advisory and support services related to emissions reporting, decarbonisation planning and climate disclosure requirements;
  • to provide our carbon accounting and emissions management services to you and your organisation, including to process emissions data, generate reports, and deliver platform functionality;
  • to contact and communicate with you about our business, including in response to any support requests you lodge with us or other enquiries you make with us;
  • to contact and communicate with you about any enquiries you make with us via any website we operate;
  • for internal record keeping, administrative, invoicing and billing purposes;
  • for analytics, market research and business development, including to operate and improve our platform, understand how users interact with our services, and develop new features and functionality;
  • for advertising and marketing, including to send you promotional information about our events and experiences and information that we consider may be of interest to you;
  • if you have applied for employment with us, to consider your employment application; and
  • to comply with our legal obligations or if otherwise required or authorised by law.

Our disclosures of personal information to third parties


We may disclose personal information to:

  • our employees, contractors and/or related entities;
  • your organisation or employer (where you are an authorised user of our platform);
  • third-party auditors or assurance providers engaged by you or your organisation to verify emissions data and reports;
  • IT service providers, data storage, web-hosting and server providers including Microsoft Azure;
  • marketing or advertising providers such as Google, LinkedIn and other professional networking platforms;
  • professional advisors, bankers, auditors, our insurers and insurance brokers;
  • payment systems operators including, but not limited to, Stripe and other enterprise payment processors;
  • our parent company and related entities within our corporate group, including Data Insight and Valocity;
  • our existing or potential agents or business partners or suppliers, or service providers who assist us in delivering our platform and services;
  • anyone to whom our business or assets (or any part of them) are, or may (in good faith) be, transferred;
  • courts, tribunals and regulatory authorities, in the event you fail to pay for goods or services we have provided to you;
  • courts, tribunals, regulatory authorities and law enforcement officers, as required or authorised by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights; and
  • third parties to collect and process data, such as Google Analytics and Google Ads (subject to your consent preferences managed through our Cookie Management Platform (CMP) and Google Consent Mode - see "Google Analytics and Google Ads Consent Management" below), Meta Pixel or other relevant analytics businesses;
  • any other third parties as required or permitted by law, such as where we receive a subpoena.

Google Analytics and Google Ads Consent Management

We use Google Analytics and Google Ads to analyse website usage and deliver targeted advertising. Google Consent Mode operates as the single control mechanism for how data is collected and shared between Google Analytics and Google Ads.

When you visit our website, our CMP captures your consent preferences for different types of cookies and data collection. These preferences are converted into consent signals that control:

  • Whether Google Analytics can collect and use cookies and device identifiers.
  • Whether Google Ads can access advertising cookies and link your activity to your Google account.
  • How your data flows between Google Analytics and Google Ads platforms.

Through our CMP (displayed when you first visit our website), you can:

  • Grant or deny consent for "ad storage" (advertising cookies and personalised ads).
  • Grant or deny consent for "analytics storage" (website analytics and performance measurement).
  • Update your preferences at any time by contacting us.

What This Means:

  • If you grant consent to "ad storage", Google Ads may use cookies, device IDs, and link your website activity to your personal Google account for personalised advertising.
  • If you deny consent to "ad storage", Google Ads will not access this information, though we may still collect aggregated, non-personalised analytics data.
  • Your consent choices are enforced through Consent Mode and apply across both Google Analytics and Google Ads.

Data Sharing

  • When you grant consent, Technical and Usage Data (including IP address, browser data, device information, and browsing behaviour) may be shared between Google Analytics and Google Ads for advertising purposes. This data may be processed on servers outside New Zealand.
  • We do not control Google's processing of your data once shared. For information on how Google uses data from sites that use their services, visit: www.google.com/policies/privacy/partners/.

Opt-Out Options

Even after granting consent, you can:

  • Update your preferences through our CMP at any time.
  • Use Google Analytics Opt-out Browser add-on: tools.google.com/dlpage/gaoptout.
  • Visit Google's Ads Preferences Manager: adssettings.google.com.
  • On Android: Open Google Settings app > select "Ads" to control settings.
  • On iOS: Use Apple’s advertising identifier settings in your device settings menu

Overseas disclosure

Personal Information

While we store personal information in New Zealand and Australia, where we disclose your personal information to the third parties listed above, these third parties may store, transfer or access personal information outside of New Zealand, including but not limited to, Australia, United States, and other countries where our cloud service providers, technology partners, and analytics providers (including Google and Microsoft) operate servers. Before disclosing any personal information to an overseas recipient, we will comply with the Australian Privacy Principles (under the Privacy Act 1988 (Cth)) and the New Zealand Information Privacy Principles (under the Privacy Act 2020 (NZ)), and will only disclose the information if:

  • you have authorised the disclosure after we expressly informed you that the overseas recipient may not be required to protect the personal information in a way that, overall, provides comparable safeguards to those under Australian and New Zealand privacy laws;
  • we believe the overseas recipient is subject to privacy laws that, overall, provide comparable safeguards to those under Australian and New Zealand privacy laws;
  • we believe that the overseas recipient is a participant in a prescribed binding scheme;
  • we believe that the overseas recipient is subject to privacy laws in a prescribed country; or
  • we otherwise believe that the overseas recipient is required to protect your personal information in a way that, overall, provides comparable safeguards to those under Australian and New Zealand privacy laws (for example pursuant to a data transfer agreement entered into between us and the overseas recipient).

Your rights and controlling your personal information

Your choice: Please read this Privacy Policy carefully. If you provide personal information to us, you understand we will collect, hold, use and disclose your personal information in accordance with this Privacy Policy. You do not have to provide personal information to us, however, if you do not, it may affect our ability to do business with you.

Information from third parties: If we receive personal information about you from a third party, we will protect it as set out in this Privacy Policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.  

Restrict and unsubscribe: To object to processing for direct marketing/unsubscribe from our email database or opt-out of communications (including marketing communications), please contact us using the details below or opt-out using the opt-out facilities provided in the communication.

Access: You may request access to the personal information that we hold about you. An administrative fee may be payable for the provision of such information. Please note, in some situations, we may be legally permitted to withhold access to your personal information. If we cannot provide access to your information, we will advise you as soon as reasonably possible and provide you with the reasons for our refusal and any mechanism available to complain about the refusal. If we can provide access to your information in another form that still meets your needs, then we will take reasonable steps to give you such access.

Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us using the details below. We will take reasonable steps to promptly correct any information found to be inaccurate, out of date, incomplete, irrelevant or misleading. Please note, in some situations, we may be legally permitted to not correct your personal information. If we cannot correct your information, we will advise you as soon as reasonably possible and provide you with the reasons for our refusal and any mechanism available to complain about the refusal.

Complaints: If you wish to make a complaint, please contact us using the details below and provide us with full details of the complaint. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take in response to your complaint. If you are not satisfied with our response, you may contact the Office of the New Zealand Privacy Commissioner.

Storage and security

We are committed to ensuring that the personal information we collect is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures, to safeguard and secure personal information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

While we are committed to security, we cannot guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk.  

Cookies

We may use cookies on our website from time to time. Cookies are text files placed in your computer's browser to store your preferences. Cookies, by themselves, do not tell us your email address or other personally identifiable information. However, they do recognise you when you return to our online website and allow third parties to cause our advertisements to appear on your social media and online media feeds as part of our retargeting campaigns. If and when you choose to provide our online website with personal information, this information may be linked to the data stored in the cookie.

You can block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies) you may not be able to access all or parts of our website.

Our website may contain links to other party’s websites. We do not have any control over those websites and we are not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. Those websites are not governed by this Privacy Policy.

Personal information from single sign-on accounts

If you connect your account with us using a single sign-on account, such as Microsoft (including Microsoft 365 or Azure AD), Google or Apple we will collect your personal information from the single sign-on provider. We will do this in accordance with the privacy settings you have chosen with that provider.  

The personal information that we may receive includes your name, email address, user ID, profile picture, and any other personal information you choose to share through your single sign-on provider.

We use the personal information we receive from the single sign-on provider to create a profile for you on our platform and enable you to access our carbon accounting and emissions management services.  

Amendments

We may, at any time and at our discretion, vary this Privacy Policy by publishing the amended Privacy Policy on our website. We recommend you check our website regularly to ensure you are aware of our current Privacy Policy.
